Terms of Service
Non-Exclusive Limited Software License
Your subscription grants you a revocable, non-transferable, and non-exclusive limited-use software license to the Outreach Engine acquisitions dialer. No geographic exclusivity or regional market monopolies are granted.
1. Software Use & Service Model
Darkhorse AI Analytics LLC (“Darkhorse AI”) provisions standard and pro campaigns on a non-exclusive software-licensing basis. We do not provide agency-managed services or custom scoping under this standard subscription model.
2. Subscription Resource Limits
To preserve outbound carrier health and system database integrity, subscription tiers are capped at strict campaign limits:
- Standard Tier ($799/mo): Maximum of 1 active campaign concurrently, with up to 3 provisioned/maintained phone numbers.
- Pro Tier ($999/mo): Maximum of 2 active campaigns concurrently, with up to 5 provisioned/maintained phone numbers.
Outbound lines are strictly subject to carrier registration guidelines, and Darkhorse AI reserves the right to rate-limit messages or pause campaigns to maintain telecommunications compliance.
3. Outbound Compliance (TCPA & carrier rules)
You are solely responsible for ensuring that all phone numbers and lead databases you upload are legally sourced. You agree to use the software in complete compliance with the Telephone Consumer Protection Act (TCPA) and mobile carrier A2P 10DLC registration guidelines.
4. Billing, Cancellations, and Refunds
Subscription licenses are billed on a recurring monthly cycle. You can cancel your campaign at any time inside your client portal. Due to upfront carrier number provisioning and database security overhead, refunds are subject to management review and are not guaranteed.
